1. Acceptance of Terms

Welcome to Orbit (元气轨迹) (hereinafter referred to as the "App" or "we"). The App is developed and operated by Yizhi Business Information Consulting (Guangzhou) Co., Ltd. (hereinafter referred to as the "Company" or "we").

Before using the App, please read these Terms and Conditions (hereinafter referred to as the "Terms") carefully. By downloading, installing, registering, or using the App, you agree to be bound by these Terms. If you do not agree to any part of these Terms, please do not use the App.

These Terms apply to all features and services provided by the App, including but not limited to AI food recognition, nutrition analysis, meal tracking, and personal data management. These Terms, together with the Privacy Policy, constitute the complete agreement between you and us.

2. Account Registration and Security

2.1 Account Registration

You may register an account using your mobile phone number or email address. During registration, you must provide accurate, true, and complete personal information. You are responsible for keeping your account information up to date.

2.2 Account Security

You are solely responsible for safeguarding your login credentials (including but not limited to passwords and verification codes) and for all activities and actions performed through your account. If you discover that your account or password has been compromised, please notify us immediately at [email protected] and we will assist you in taking protective measures as soon as possible.

We recommend that you use a strong password and change it regularly to reduce the risk of unauthorized access.

2.3 Account Usage Restrictions

You may not transfer, lend, or authorize third parties to use your account. Without our prior written consent, you may not use automated tools (such as crawlers or scripts) to access the App or collect user data.

3. Services

3.1 Core Features

• AI Food Recognition: Using AI technology to identify food types from photos and estimate nutritional content, providing personalized nutrition analysis reports.
• Meal Tracking: Recording your daily food intake to help you track nutritional consumption.
• Nutrition Goal Management: Recommending daily nutrition targets based on your physical data (height, weight, age, gender, etc.) with the option to adjust them manually.
• Health Recommendations: Providing personalized health suggestions and dietary guidance based on your eating habits and physical data.

3.2 Paid Features

The App offers both free and paid modes. Some advanced features (such as unlimited AI recognition, detailed nutrition analysis reports, exclusive health recommendations, etc.) require a paid membership subscription ("Plus Membership"). Detailed descriptions of paid features will be clearly displayed within the App and presented to you before purchase.

3.3 Service Changes and Suspension

We reserve the right to modify, suspend, or terminate all or part of the App's features at any time for any reason. If service needs to be suspended due to system maintenance, upgrades, technical issues, or force majeure, we will notify you in advance whenever possible.

4. Intellectual Property

4.1 Our Intellectual Property

The App's name, logo, UI design, source code, algorithms, technical architecture, database structure, icons, illustrations, text content, and other materials are owned by the Company or have been legally licensed, and are protected by Chinese and international intellectual property laws. Without our written permission, you may not copy, modify, distribute, reverse engineer, decompile, or create derivative works based on the App.

4.2 User-Generated Content

You retain ownership of the food photos, meal records, physical data, and other content you upload through the App. You grant us a non-exclusive, worldwide, royalty-free license to use this data to provide AI recognition, nutrition analysis, and other core services.

We will not use your personal data for any purpose other than providing these services, nor will we provide your personal data to third parties without your explicit consent. For more details on data processing, please refer to our Privacy Policy.

5. User Conduct

When using the App, you agree to comply with the laws and regulations of the People's Republic of China and the country/region in which you reside, and you agree not to engage in the following activities:

• Using the App to disseminate illegal, violent, obscene, false, or infringing content;
• Interfering with or disrupting the normal operation of the App, including but not limited to attacking servers, injecting viruses, or maliciously scraping data;
• Using automated scripts, crawlers, or other non-human means to access or collect data from the App;
• Impersonating others or using another person's identity information to register an account;
• Engaging in any activity that may harm our interests or the interests of other users.

If you violate the above rules, we reserve the right to suspend or terminate your account immediately and pursue legal remedies as appropriate.

6. Payment and Refund Policy

6.1 Subscription Period and Pricing

Plus Membership is offered on a subscription basis, with monthly and annual options available (specific periods as displayed in the App). Pricing is as displayed in the App. We reserve the right to adjust prices based on market conditions, but such adjustments will only take effect after your current subscription period ends.

6.2 Automatic Renewal

Your Plus Membership subscription will automatically renew unless you cancel automatic renewal at least 24 hours before the end of your current subscription period. Renewal fees will be charged to your Google Play account at the beginning of each subscription period.

6.3 Cancellation

You may cancel automatic renewal at any time through the "Subscriptions" page in your Google Play account settings. After cancellation, you will continue to enjoy full Plus Membership benefits throughout the remainder of your current subscription period.

6.4 Refund Policy

All paid subscriptions are processed and refunded by Google Play. If you are not satisfied with your subscription, please contact Google Play customer support within 48 hours of purchase to request a refund. Refund requests made after 48 hours or for partially used subscriptions will be subject to Google Play's refund policy.

If you experience duplicate charges or incorrect charges due to technical issues, please contact us at [email protected] and we will assist you after verification.

6.5 Free Trial

We may offer free trial periods from time to time (e.g., 3-day trial). After the trial period ends, your subscription will automatically convert to a paid subscription unless you cancel. During the trial period, you will enjoy the same benefits as a paid member, and no charges will apply if you cancel before the trial ends.

7. Termination

7.1 User-Initiated Deletion

You may request to delete your account at any time through the "Delete Account" feature within the App (or by emailing [email protected]). Upon completion, all your personal data (including meal records and physical data) will be permanently deleted and cannot be recovered.

7.2 Termination by Us

If you violate any provision of these Terms, we reserve the right to suspend or terminate your account and delete associated data without prior notice.

We also reserve the right to cease operation of the App at any time. If we decide to discontinue the service, we will notify you at least 30 days in advance via in-app notification or email, and you will have the opportunity to export your personal data before the service ends.

8. Disclaimer

The AI food recognition and nutrition analysis results provided by the App are for informational purposes only and do not constitute medical advice, diagnosis, or treatment. For any health concerns, please consult a qualified doctor or nutritionist.

We strive to ensure the accuracy of AI recognition results, but due to the inherent limitations of AI technology, results may contain errors. We are not responsible for any direct or indirect losses resulting from reliance on AI recognition results.

The App is provided "AS IS" without any express or implied warranties. To the fullest extent permitted by law, we make no warranties regarding the suitability, accuracy, reliability, or security of the App.

9. Limitation of Liability

To the fullest extent permitted by law, the Company and its affiliates, employees, partners, and service providers shall not be liable for any direct, indirect, incidental, special, or consequential damages arising from:

• Use or inability to use the App;
• Reliance on AI recognition results or nutrition analysis data;
• Service interruptions due to network failures, device malfunctions, system maintenance, or other causes;
• Losses resulting from force majeure events (such as natural disasters, wars, government actions, internet service interruptions, etc.).

In any case, our total liability shall not exceed the total subscription fees you have paid to us in the twelve months preceding the dispute.

10. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the People's Republic of China.

Any dispute arising out of or relating to these Terms shall first be resolved through friendly negotiation between the parties. If negotiation fails, either party may bring a lawsuit to the competent people's court at the Company's location.

For subscription services provided to international users, the limitations of liability and disclaimers in these Terms also apply. If there is a conflict between these Terms and the mandatory laws of your country/region, the mandatory laws of your country/region shall prevail.

11. Changes to Terms

We may revise these Terms from time to time due to business developments or changes in laws and regulations. We will notify you of any changes through prominent notices within the App and obtain your consent before the changes take effect (where required by law).

These Terms are effective as of August 7, 2026. We recommend that you review this page regularly to stay informed of the latest terms. If you do not agree to the revised Terms, you have the right to stop using the App and delete your account.
